MODERN ORGANIC CONTEMPORARY COLLECTION (MOC COLLECTION)

ONLINE POLICIES

 

PRODUCT WARRANTY:

Modern Organic Contemporary Collection (herein referred to as MOC Collection) furniture comes with a one (1) year manufacturer’s warranty against product defects.  All claims for damages or defects must be reported to MOC Collection within 2 business days from delivery receipt.  MOC Collection will file a claim with the respective manufacturer for their review, who may, at their sole option repair or replace the defective product. Failure to report damages or defects within the allotted time frame will result in the claim being denied and not covered.  Other denied claim exclusions include improper use, abuse, damage, outdoor use, or commercial uses that are not covered under this warranty. Written notice of any claim should include proof of purchase, description of the problem, and a photograph of the defect. Natural marks or wrinkling of leather are not defects, but are proof that genuine cowhide is used. Application of improper substances, spills from paint, dyes, or acids, or exposure to direct sunlight or other heat source to the leather are not covered. Cushions will naturally soften over time, as a result of normal use, and should not be confused with loss of resilience due to defects in construction materials.

 

Exception: Special orders are non-refundable.  Special orders are any item not stocked by the manufacturer and is specifically custom made to order based on the customer requirements and requests.

 

ORDER CANCELATION:

Customer may cancel or change the order in part or in full for a refund within two (2) business days as long as the order has not shipped.  Please note, some orders are processed and shipped in less than 72 hours, so please call our Customer Service as soon as practically possible 1-888-446-4315.  Once the order is shipped, we cannot cancel or change your order.  If the order is shipped and you must still cancel, our standard return policy will apply and the customer is responsible for freight charges both ways (outbound and inbound) as well as 35% restocking fee.  There are no exceptions.

 

SPECIAL ORDERS:

Special orders are items not stocked by manufacturer and are made to order for the customer.  Special orders require 60% deposit to start production. Special orders can be changed and/or modified within 2 business days from date of purchase.  After 48 hours, special order deposits become non-refundable and cannot be changed and/or modified.  If client cancels a special order item after 48 hours, a store credit will be issued which can be used towards another MOC Collection item.

 

Delivery times for special orders vary depending on the manufacturer and the specific item being ordered; normally special orders are shipped 8-12 weeks from the deposit date.

 

 

RETURN POLICY:

 

Return items must be in their original condition, box and packaging, no exceptions.   Any item being returned or refused by client after being shipped will be charged a 35% restocking fee that is the responsibility of the client.   If an item is damaged or defective MOC Collection will replace the item if in stock.  If the item is no longer in stock a full refund will be issued based on the form of payment used.

 

SHIPPING & HANDLING:

 

We offer FREE SHIPPING on all purchases in the Continental United States only.   All orders to Canada are subject to shipping fees, taxes and broker fees.  Orders are shipped via ground service which can take up to 4 weeks from date of purchase for delivery of in-stocked items; we use LTL (less than truck load) Freight Companies for all our shipments.  All shipments via Freight Companies are curbside delivery only, which means that you will need to accept freight at the street level.  White glove is available upon request and is subject to additional charges.  White glove delivery service includes inside delivery, setup and installation. White glove and delivery fees to Canada must be paid in full prior to your scheduled delivery date, no exception.

 

All shipments must be inspected before signing clear delivery; any concealed damages noted after signing delivery must be reported within 48 hours to avoid claim denial. All claims for damage or defect must be reported in writing and original packaging must be available for inspection and/or return. Please retain the original packaging upon receipt , unfortunately we cannot accept any claims without original packaging, since all claims require return authorization and must be shipped back only in original box it was received in.

 

We ship throughout the United States and Canada.  We do not ship to Hawaii, U.S. Virgin Islands, Puerto Rico or Alaska.

 

EXPEDITED SHIPPING:

 

We offer expedited service at an additional cost for items that are in stock. You must call customer service for additional details.

 

BUYER’S RESPONSIBILITY:

 

In the unlikely event that your product arrives damaged, you should write down any and all

Damage’s on the delivery receipt before the carrier leaves. Please retain all original packaging materials as it is required by the carrier and the manufacturer for damage and claim inspection. Damage claims without the original shipping container are automatically denied by the shipper. Our freight is insured and you have every right to file a freight claim with the carrier if they did not handle your products properly. If you see visible damage to the cartons; please inspect the carton before the carrier leaves. Often, the box can get damaged, however we use bubble and/or foam wrap around the product which keeps the item intact and not likely to damage. If you discover the product is damaged, you can choose to (1) keep the product and file a claim (ask for a claim form from the driver and ensure the damages are noted on the delivery receipt), or (2) refuse the product and have it sent back. It is a good idea to document any problems with a digital camera if possible.

 

* Please note that if a replacement is not wanted, the standard return policy will apply.

 

SHIPPING TO CANADA:

 

Canadian shipments will only be shipped to verified billing address on file with the credit card company. We will not ship to a different address other then the one confirmed by the credit card company. A faxed copy of the credit card with a signature authorizing the transaction may be required for shipping approval.

 

Canadian orders usually arrive within 0–15 business days depending on stock, ship-to address, and customs regulations. A confirmation of shipment will be sent via email when the order is shipped, detailing the service and freight information.

 

MOC Collection is required by law to mark all international packages as merchandise and to list the actual contents on customs forms. We are not responsible for any associated taxes, duties, customs fees that are charged by Canadian customs. Upon arrival of your order, a designated customs broker will contact you to clear any duties and fees for the shipment to be delivered. Buyer may be asked to go to local customs house for shipment clearance for any package that is refused, rejected, or returned for failure of delivery.

 

MOC Collection reserves the right to charge all related inbound and outbound shipping costs and fees.

 

PAYMENT:

 

MOC Collection authorizes your credit card for the total amount of your order upon confirmation of order.

 

Premium White Glove Deliver

 

MOC Collection “Premium White Glove Delivery “for selected items. This delivery service provides,

Two – man delivery, to the inside your residence to the room you choose. This service includes carrying the produce up two flights of stairs from the building threshold (4-15 steps = 1 flight). Once the product is in the room you desire, the shipper will unpack the product and provide basic setup that requires basic tools

(I.e. pieces will be screwed or bolted together, set pieces next to each other or on top of each other). The shipper will also remove and dispose of all packing materials.  Any charge that is paid by the consumer for shipping does not constitute white glove delivery unless otherwise stated “White Glove Delivery “.

     Please note: the shipper will not hook up any electrical or component wires.


 

DELIVERY ACCEPTANCE INSTRUCTION:

 

The freight company’s receipt should not be signed before you have completed the inspection. The driver must wait for you to complete it. Without the original packaging materials, you will not be allowed to return or exchange the purchased furniture. If any damage is observed during the inspection, or the truck driver has refused to wait, notify us immediately at (888-446-4315). If any damage is observed during the inspection, you may refuse to accept the damaged item, and if the damage is to multiple items then you may choose to refuse the entire shipment. If you do accept the shipment, make sure all damage is itemized in order to assure your charge- free exchange. If you refuse delivery of an item that is in good condition and neither damaged or defective you will be responsible for freight charges for both ways.

 

Will my item look exactly like the picture?

 

Color, texture, and graining variations can occur in natural products like leather, wood and stone. These are not normally considered imperfections. For leather products all colors are bound to have variations in every production line. Color representations on computer terminals and screens can be different based on settings and various display technologies. To optimize website performance, product pictures have been scaled down in detail to help make web pages load faster. As a direct result, in some small cases fine detail in the pictures of furniture may have been sacrificed for the website’s performance. It is the customer’s responsibility to request additional high resolution pictures so that they may see exactly what they are getting before purchasing. The customer also agrees that they may not dispute the finish, or color, or texture or any other physical attribute after taking delivery of a product.

 

Before I buy, what are the Terms and Conditions?

LIMITATION OF LIABILITY

 

IN NO EVENT WILL MOC COLLECTION OR ITS SUPPLIERS BE LIABLE FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF THE USE OF THE SITE OR FOR SERVICES PROVIDED BY MOC COLLECTION INCLUDING, WITHOUT LIMITATION, DAMAGES OR COSTS RELATING TO THE LOSS OF PROFIT,BUSINESS, GOODWILL, DATA, COMPUTER PROGRAMS, LOSS OF INFORMATION OR PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM THAT ARISE OUT OF OR OTHERWISE ARE RELATED TO THE USE OF, OR THE INABILITY TO USE, THE CONTENT OR THE SITE OR ANY LINKED WEBSITE, THE STATEMENTS OF ANY THIRD PARTY ON THE SITE, OR UNAUTHORIZED ACCESS TO THE SITE, YOUR TRANSMISSION, YOUR ACCOUNT OR YOUR PASSWORD, EVEN IF MOC COLLECTION IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY SIMILAR CLAIM AGAINST YOU BY ANOTHER PARTY. THE ABOVE EXCLUSION OF INCIDENTAL AND CONSEQUENTIAL DAMAGES MAY NIT BE ENFORCEABLE UNDER SOME APPLICABLE LAWS, SO SUCH EXCLUSION MAY NOT APPLY TO YOU. IN NO CASE SHALL MOC COLLECTION LIABILTY FOR MONEY DAMAGES EXCEED THE MOC COLLECTION INVOICE AMOUNT PAID BY YOU FOR THE PRODUCT.

By visiting and/or using MOC Collection’s site in any way, such as browsing products or placing an order, you agree to MOC Collection policies and procedures outlined. Please read them carefully. These terms and conditions may change with or without notice and are effective immediately upon posting.

 

We reserve the right to cancel products or services to any customer for any reason. The customer’s sole remedy in such cases will be the full refund of any funds we have collected in reference to the cancelled products and/or services.

 

We attempt to provide current and accurate information on this website, and via e-mail and telephone communications. We do not, however, warrant that all the information is current in some cases. All dimensions and measurements on our website are manufacturer’s best approximations. We do not guarantee color, tones, finishes, or shades on any item because screen settings may vary from computer to computer.
